4.ORDER PROCESS
Orders will only be accepted from persons over the age of 18. Orders may be accepted from persons resident outside the United Kingdom.
All orders are subject to acceptance and availability. If any goods ordered are not available, you will be notified by email and you will have the option either to wait until the item is available from stock or to cancel your order.
It is your responsibility to provide us with a valid email address so that we can contact you if necessary.
Any orders placed by you will be treated as an offer to purchase the goods or services from us and we have the right to reject such offers at any time prior to acceptance.

5.DELIVERY
Delivery of our services is via the internet.
We cannot be held responsible for any connectivity, routing, Broadband / DSL / Cable issues from any ISP (Internet Service Provider) between you and us.
If connection problems occur at any point before or during a remote support session resulting in a failure to connect to our service or the service to be interrupted, we will endeavour to start or resume the support session from the point of the connection failure when connectivity has been restored. In the case of a failure of your Broadband provider services, please endeavour to contact us when your service has been resumed.
6.PAYMENT
All prices are inclusive of VAT (where applicable) at the current rates and are correct at the time of entering the information onto the system.
Prices quoted are for delivery (in the case of goods) and for performance (in the case of services) in the United Kingdom unless otherwise specified.
Prices are in Pounds Sterling unless otherwise specified.
We reserve the right, by giving notice to you, the buyer, at any time before delivery or performance to increase the price of goods or services to reflect any increase in the cost to us, which is due to any factor beyond our control (such as without limitation, any foreign exchange fluctuation, significant increase in the costs of labour, materials or other costs of manufacture).
In the unlikely event of there being such an increase in the price of goods or services you, the buyer, shall be entitled to cancel the order at any time before delivery or performance.
In the unlikely event that the price or description of an item or service has been incorrectly advertised, we will contact you by email, telephone or post to ask whether you wish to proceed with your order with the correct price or description. If you are not happy to proceed, or we are unable to obtain your instructions, we will cancel the order. Unless we have already dispatched or commenced performance of your order, we will not be obliged to supply products or provide services at the incorrect price or based on an incorrect description.
Payment can be made by any major credit or debit card or through an electronic payment account as explained on the prices page.
One Time Fix Payment will be requested from your account after the provision of the service to you.
By placing an order and initiating a remote support session from an engineer at inub.co.uk, you, the buyer, consent to payment for the service.
Payment will be requested by email to the address specified by the buyer upon the completion of a remote support session
When you pay for your order by credit or debit card, we carry out checks or 'authorisations' with the card issuer for security reasons. Should any problems occur with the authorisation of your card, we will contact you with further details.
Payment for our basic and ultra packages will be taken in advance by direct debit through the use of Payapl Services.
Basic and ultra subscription packages allow for one years (12 months) remote support services from the date of purchase and is subject to our fair usage policy and scope of work as defined on the prices and FAQ section of our website.
7.ELIGIBILITY
To be eligible to purchase goods or services on this Website and lawfully enter into and form contracts on this Website, you must:
• if an individual, be 18 years of age or over; and
• register your real name, address, phone number, email address and any other details requested.
If you are under 18, please ask an adult to contract on your behalf.
By offering to purchase goods and services, you represent to us that you are 18 years of age or over and authorise us to transmit information (included updated information) to obtain information from third parties, including but not limited to, your debit or credit card numbers or credit reports to authenticate your identity, to validate your credit card, to obtain an initial credit card authorisation and to authorise individual purchase transactions.
8.RETURNS, CANCELLATIONS AND SUBSTITUTIONS
8.1.CANCELLATION
For subscription based services (excluding One Time Fix):
Please note that you are entitled to cancel any contract completed with us within 7 working days of receipt of the goods or services.
If you do cancel a contract, then you must notify us in writing by sending an email to admin@inub.co.uk or a letter to The Annexe Naish Farm Back Street, West Camel Yeovil Somerset BA22 7QF.
You also have the right to cancel your order prior to despatch or performance within 7 days of placing it.
If any remote support sessions have been used within the 7 day period on receipt of the goods or service, a sum of £39.99 per session will be charged to cover our costs.
We cannot cancel or refund a subscription order after the 7 working days receipt of the goods or services.
For One Time Fix and special offers:
You may cancel the one time fix and any special offer up to any point before a remote support session has been established. The definition of a remote support session being established is when a chat window (our remote support applet / application) window has been opened.
Once a remote support session has commenced, the service can not be cancelled.
9.INTELLECTUAL PROPERTY
The content of the Website is protected by copyright, trade marks, database and other intellectual property rights and you acknowledge that the intellectual property rights in the material and content supplied as part of the Website shall remain with us or our licensors.
You may download or copy the content and other downloadable items displayed on the Website subject to the condition that the material may only be used for personal non-commercial purposes.
Copying or storing the contents of the Website for other than personal use is expressly prohibited.
You may retrieve and display the content of the Website on a computer screen, store such content in electronic form on disk (but not any server or other storage device connected to a network) or print one copy of such content for your own personal, non-commercial use, provided you keep intact all and any copyright and proprietary notices.

You agree to fully indemnify, defend and hold us, and our officers, directors, employees and suppliers, harmless immediately on demand, from and against all claims, losses, costs and expenses, including reasonable legal fees, arising out of any breach of these Conditions by you, or any other liabilities arising out of your use of this Website or any other person accessing the Website using your Personal Information with your authority.
This clause does not affect your statutory rights as a consumer, nor does it affect your contract cancellation rights.
11.4. Liability Exclusions
We do not have specific knowledge of your computer and its configuration. Whilst we will use our best efforts to minimise disruption to your system, we cannot be responsible for any unforeseen consequences of our services.
Our services may affect manufacturer warranty validity. It is your responsibility to assess the effect of our services on any manufacturer's warranty and take appropriate action.
We cannot be responsible or liable to you in relation to any service regarding:
any loss or corruption of data, information or records;
any loss of goodwill, or any loss of (or interruption to) business or contracts;
any failure by you to follow our reasonable advice, recommendations or instructions;
any losses you may suffer arising from your use of (or failure to use) any anti-virus software; and
any loss that is not reasonably foreseeable.
We cannot be liable for any hardware, software or peripheral failure including any attached devices, cameras, video camcorders, usb and flash drives, mp3 players, mobile phones, satellite navigation systems, dongles, speakers and televisions before or during or after a remote support session has been established.
12.FORCE MAJEURE
We shall have no liability for delays or failures in delivery or performance resulting from force majeure, including but not limited to, war, demands or requests of Government authorities, strikes, shortages of labour, fuel, power, raw materials, late or defective performance or non-performance by suppliers, transportation disruptions, inability to ship or other causes, beyond our reasonable control.
13.REGISTRATION
You warrant that:
13.1. the personal information which you are required to provide when you contact us is true, accurate, current and complete in all respects;
13.2. you are not impersonating any other person or entity and
13.3. you will notify us immediately of any changes to your personal information by emailing or telephoning our customer service representatives.
14.PRIVACY POLICY

15.THIRD PARTY RIGHTS
Except for our affiliates, directors, employees or representatives, a person who is not a party to these Conditions has no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of this agreement but this does not affect any right or remedy of a third party that exists or is available apart from that Act.
16.EXTERNAL LINKS
To provide increased value to our users, we may provide links to other website's or resources for you to access at your sole discretion.
You acknowledge and agree that, as you have chosen to enter the linked website we are not responsible for the availability of such external sites or resources, and do not review or endorse and are not responsible or liable, directly or indirectly, for:

17. Calling Card and subscription services.
Basic and Ultra subscriptions
The basic and ultra service is purchased by the customer for one years (12 months) remote support.
Both the basic and ultra support packages are subject to a Fair Usage policy
The duration of one remote support session shall not exceed one hour 30 minutes. If the work is completed in under one hour 30 minutes then you will not receive a discount or refund for the remaining time or save for a later date and will count as one of your allocated remote support session quotas for the month. If more time is required to extend the support session then this is counted as a second remote support session and will be deducted from you monthly remote support session quota. If no remote support sessions remain in your monthly quota, then additional engineer time can be purchased. Please contact us for details.

18. Systems, Hardware and Software Excluded
Our services are for home PC Users and as such exclude support for the following:
File servers
server operating systems
Domain & active directory based networks;
Complex Firewall's
VPN and WAN networks;
Corporate or business infrastructure hardware;
Business support unless otherwise stated;
Unix and its derivatives;
Apple Mac;
Home Business users unless by written arrangement prior to a remote support session;
9. Remote Services
Given the nature of our service, certain hardware and software problems can not be fixed remotely.
Certain networking issues cannot be fixed remotely and as such are excluded.
One time fix, basic and ultra subscriptions are remote support products and do not include home visits or the cost or repairing hardware or software failures.
Our Remote support services can only be accessed via broadband.

We cannot provide support for issues not listed in the what is covered sections without prior written notification and consent
One time fix:
This service is charged at a fixed fee.
The duration of a one time fix is limited to 1 hour 30 minutes. If the work is completed in less than 1 hour 30 minutes you will not receive a discount or refund for the remaining time or save for a later date. If more time is required to extend the support session you may be required to pay additional charges or request a new session chargeable at the standard rate. We will advise you of this during the session if required. See prices on main website.
You agree to pay us the applicable fee by the end of the support session and we will invoice you using the details you have provided.

20. Your Responsibilities.
You must back up all software and data stored on your PC prior to an engineer connecting;
You agree that it is your entire responsibility to back up your important files and data prior to using our services;
You must have valid software licences for your operating system and all applications on your computer(s). You must supply details of the relevant licence keys if we ask you for them.
An inub engineer will ask you for consent to access your computer using our remote access facility before or during the provision of this service. You must agree to this access to enable us to provide the service. If you do not, we may not be able to provide the service to you.
21. Our Responsibilities
We may not be able to advise on all issues or to repair or solve all problems that you ask us to, but to the extent that we cannot advise on an issue or repair or solve a problem that we agreed was included in the scope of our services then we will refund any applicable fee paid by you to us.
Separately we may not be able to fulfil any service requests that fall outside the agreed scope of our services, in which case no refund will be payable.
If you use our remote support service and the problem we have fixed occurs again within 5 days as a direct result of the same cause(s) we identified when we fixed it for you the first time, provided you have fully complied with these terms of service, we will:
(i) try again to fix the problem at no extra charge; and
(ii) if we cannot then fix the problem again, we will return your money at the full purchase price for the services performed.
Exclusions.
For any repairs necessitated by a virus or spyware, each of the above service warranties is only valid if you have up-to-date anti-virus and anti-spyware protection installed or updated during the repair or immediately thereafter. This service warranty excludes any defective hardware or other products.
21.1. We will not be responsible to you:
(i) For any inherent failures in or caused by the supported applications and operating systems or third party products supplied by us;
(ii) For the repair or replacement of any equipment that is faulty (as reasonably diagnosed by us during the provision of our service to you);
(iii) For any failure by you to follow our reasonable advice, recommendations or instructions;
(iv) If either we, including without limitation any of our engineers, agents, contractors or third party service providers are impaired or stopped from providing the service by you for any reason whatsoever or are otherwise unable to provide a service to you as a result of any event that is outside our reasonable control;
(v) For any damage to your hardware or equipment.
(vi) For any loss of files or data on your PC or attached devices, memory sticks, hard drives or cameras.
21.2 We shall not be liable to you for:
(i) any loss that is not reasonably foreseeable;
(ii) any loss calculated by reference to profits, income, or business (or loss of such profits, income, or business);
(iii) any loss of goodwill;
(iv) any loss or corruption of data; or
(v) any losses you may suffer arising from your use of (or failure to use) any anti-virus software.
21.3 We do not accept liability for the acts or omissions of any providers of telecommunication services.
21.4 Our aggregate liability, whether in contract or for negligence or breach of statutory duty or otherwise, to you for any loss or damage of whatsoever nature and howsoever caused shall be limited to and in no circumstances shall exceed £1,000 for any one incident or series of related incidents.
21.5 The limitations of liability set out in this clause 5, are in addition to any other provisions limiting our liability set out elsewhere in these terms of service.
21.6 Nothing in these terms of service shall impose any liability on us in respect of non-performance of a service where the performance claimed is outside these terms of service or where such non-performance is directly due to your acts, omissions, negligence or default.
21.7 We shall have no responsibility to you for any goods, services, information, software or other materials that you use or obtain when using your personal computer whether offline or online for accessing the internet (including e-mail).
22.Minimum Requirements for our Services
If you use our services, you must have a fully working and licensed personal computer meeting the following minimum requirements:
(i) Windows 2000 (or a more recent version), XP, Vista or Windows 7 operating system;
(ii) Processor speed of 233MHz or above;
(iii) 256MB RAM;
(iv) 200MB available hard drive space;
(v) an available USB, ethernet or wireless port; and
(vi) a compatible modem or, where applicable, wireless router.
23.GOVERNING LAW AND JURISDICTION
The Website is controlled and operated in the United Kingdom.
The Conditions will be governed by the laws of England and Wales and you irrevocably agree to submit to the exclusive jurisdiction of the courts of England and Wales.
